CIVIL LIABILITY OF THE POLLUTER

Abstract

This article intends to explain the civil liability of the polluter in framework of civil law. Compared to public law, private law contains some inadequacies to protect environment but such deficiencies do not annihilate the civil liability of the polluter. In this context, the responsibility of the polluter will be examined based on private law. In doing so, the rules of neighbourhood law and Turkish Code of Obligation's absolute liability cases, will be considered. Lastly, polluter's liability will be propound pursuant to Environment Act.
